1. Introduction
Welcome to Softury. By using our services or placing an order through our website, you agree to these Terms and Conditions. Please read them carefully before making a purchase.
2. About Softury
Softury delivers complete websites based on fixed packages. We use our own platform, our own systems, and our own technology to build, host, and manage websites.
3. Our services
Softury provides the following services:
- Website development based on one-time packages
- Hosting websites via our own infrastructure
- Access to a portal for institutions, media, and form submissions
- Email support during business hours
Additional hosting or support subscriptions may be offered in the future.
4. Ordering and development
After payment, we will immediately start with the technical creation of your website. This includes, among other things:
- Automatic setup of the website in our systems
- Technical provisioning within our infrastructure
You will go through an onboarding process in which you provide information about your company and website.
During the development phase, customers can request minor revisions if they are not satisfied with the initial design. Major changes or complete redesigns are not included.
5. Ownership & rights of use
Softury retains full ownership of:
- All source code
- The Softury platform
- All technical systems and tooling
- Templates, infrastructure, and software
The customer is granted a right to use the website for as long as it is hosted by Softury.
Websites will not be transferred, exported, or made available as code files.
Upon termination, the right of use expires and the website is taken offline.
6. Hosting
Websites are hosted via Softury's own infrastructure.
Softury ensures reasonable availability, security, and technical management.
We cannot guarantee 100% uptime and are not liable for temporary interruptions.
7. Support
Support is provided via email.
Office hours: Monday through Friday, 9:00 a.m. to 5:00 p.m. (Dutch time).
Support included:
- Minor content or visual updates
- Minor technical fixes
- Limited revisions during development
Not included:
- Major changes
- New functionality
- Complete redesigns
- Outside office hours (unless otherwise agreed)
8. Prices and payment
All prices relate to the selected package and the associated services.
Payment is processed via Stripe.
We will only start creating the website once payment has been completed.
9. Cancellations & refunds
Because Softury starts setting up the website immediately after payment, cancellations are not possible.
No refunds will be offered.
The customer waives the right of withdrawal, as this is a digital service that is performed immediately.
10. Customer responsibilities
The customer must provide accurate and complete information during onboarding.
The customer is responsible for all content on their website.
It is prohibited to misuse the platform, including:
- Posting illegal or harmful content
- Spam
- Security breaches
- Misuse of Softury's infrastructure
11. Integrations & external services
Customers can choose to use integrations such as:
- Google Analytics
- Google Ads
- Meta Pixel
- Other external marketing or tracking services
By linking integrations, the customer consents to data processing by these third parties. Softury is not responsible for the privacy or data policies of external parties.
12. Privacy
Softury processes personal data in accordance with our Privacy Statement. By using our services, you agree to this.
13. Termination of services
The customer may discontinue use of the service at any time.
Upon termination:
- The website is taken offline
- Access to the portal is terminated
- Data can be deleted after expiration
- The website will not be transferred, exported, or made available
14. Liability
Softury is not liable for:
- indirect damage
- third-party liability
- data loss
- damage caused by external parties
Softury's total liability shall always be limited to the amount paid for the service.
15. Applicable law
These terms and conditions are governed by Dutch law. Any disputes shall be submitted to the competent court in the Netherlands.
16. Changes to these terms and conditions
Softury may amend these terms and conditions. The most recent version is always available on our website.
